Climate Change -- Roundtable Weighs In On Suggested EPA “Endangerment Finding” For CO2

In July, the Environmental Protection Agency released an Advanced Notice of Proposed Rulemaking inviting public comment on the benefits/ramifications of regulating greenhouse gases (GHGs) under the Clean Air Act (CAA).

This regulatory process was in response to the U.S. Supreme Court's decision in Massachusetts vs. EPA. That case found that the CAA authorizes EPA to regulate vehicles' tailpipe GHG emissions, if EPA determines they cause or contribute to air pollution that may reasonably be anticipated to endanger public health or welfare. �The Roundtable began engaging with EPA on this issue in advance of the rulemaking. We sent a lengthy letter to the Agency outlining our deep concerns regarding the consequences of such an approach.  We also engaged substantively in the public comment period.
